As of 2025, the Intellectual Property (Unregistered Rights) (Jersey) Law 2011 remains the copyright statute in force in Jersey. The law has been amended several times (point-in-time versions are available for dates through 11 January 2024, which is the current version as shown on jerseylaw.je). Article 46 continues to provide fair dealing for the purposes of research (non-commercial) and private study. 'Fair dealing' covers any act restricted by copyright, applies to any user, and covers literary, dramatic, musical and artistic works. This remains GREEN. The non-commercial restriction on research is classification-neutral. No TDM-specific exception has been identified in the Jersey law. The library/archive exceptions (Articles 55-66) and educational exceptions (Articles 67-72) remain in force but are less permissive than the general fair dealing provision. On 1990-01-01, the copyright law in force in Jersey was the Copyright Act 1911 (UK), which had been extended to Jersey and maintained in force there by paragraph 41 of Schedule 7 to the Copyright Act 1956 and then by paragraph 36(1) of Schedule 1 to the Copyright, Designs and Patents Act 1988. The 1911 Act was not repealed as it extends to Jersey until 2013 (by the Copyright (Repeal of the Copyright Act 1911) (Jersey) Order 2012, SI 2012/1753, which came into force on 1 January 2013 alongside the Intellectual Property (Unregistered Rights) (Jersey) Law 2011). Section 2(1)(i) of the 1911 Act provided that copyright was not infringed by 'any fair dealing with any work for the purposes of private study, research, criticism, review, or newspaper summary.' This fair dealing exception covers 'dealing' (any exclusive right, not limited to reproduction), applies to 'any work' (all types), is open to any user (not restricted to institutions or individuals only), and covers research and private study. This maps to GREEN. The non-commercial restriction is not present in the 1911 Act's fair dealing clause.
