Current rationale

As of 2025, the Law on Copyright and Related Rights (as last amended by Law No. 1488 of 02.01.2018) remains in force. The most permissive research-relevant exception is Article 20, which permits reproduction of lawfully disclosed works exclusively for personal purposes. This covers reproduction by any individual for personal use (including private study and research), but Article 21 excludes: (1) architectural works as buildings, (2) databases or substantial parts, (3) computer programs, and (4) reprographic reproduction of entire books and musical scores. This means full-work reproduction is permitted for some types of works (e.g., journal articles, photographs, audiovisual works, shorter literary works) but not for entire books (reprographically), databases, computer programs, or musical scores. This work-type restriction maps to ORANGE. Article 20 covers only reproduction (not sharing/communication), and is limited to personal purposes (individual users). Article 22(1) permits quotation for scientific/research purposes but is limited to excerpts justified by the purpose — this is RED individually. Article 22(2) permits educational illustration use — also limited to excerpts. No TDM-specific exception exists. No general fair use or fair dealing clause exists. No library/institutional exception broader than the personal-use exception was found. The non-commercial nature of personal use and the lawful-disclosure requirement are classification-neutral factors and did not affect the color assignment.

Why this score

Tajikistan was part of the Soviet Union until September 1991. On 1990-01-01, the applicable copyright law would have been the Soviet copyright provisions (likely the 1961 Fundamentals of Civil Legislation of the USSR and Union Republics, and the Tajik SSR Civil Code). I was unable to retrieve or verify the actual text of the Tajik SSR Civil Code provisions on copyright exceptions in force on 1990-01-01 via web search. No digitized version of the relevant Soviet-era Tajik copyright provisions was found. Therefore, the baseline is marked AMBIGUOUS with empty fields.

Why this score

The most permissive research-relevant exception is Article 20 (reproduction for personal purposes), which permits reproduction of lawfully disclosed works for personal purposes without consent or payment. However, Article 21 carves out several categories of works: works of architecture (as buildings), databases or substantial parts thereof, computer programs, and reprographic reproduction of books in their entirety and musical scores. This means a researcher can reproduce full works of many types (e.g., articles, shorter literary works, audiovisual works, photographs) for personal purposes, but cannot reproduce full books (reprographically), databases, computer programs, or musical scores. This is a work-type restriction that maps to ORANGE. Article 22(1) permits quotation for scientific/research purposes but only to the extent justified by the purpose of quotation — this is limited to excerpts/quotations (RED individually). Article 22(2) permits use of works as illustrations for educational purposes — limited to excerpts and educational context. The personal-use exception (Art. 20) is the most permissive but its work-type exclusions (Art. 21) make it ORANGE rather than LIGHT BLUE. Non-commercial restriction and lawful-access requirements are classification-neutral.

Why this score

The 2003 amendment (Law No. 27 of 1 August 2003) is referenced in the consolidated text and in the Wikipedia article on Tajik copyright law. However, I was unable to retrieve the specific text of the 2003 amendments to verify whether Articles 20-22 were materially changed. The consolidated text on base.spinform.ru reflects all amendments through 2018, making it impossible to isolate the 2003 changes. Based on available information, the core structure of Articles 20-22 (personal reproduction with work-type exclusions, quotation for research) appears to have remained substantively similar. The classification remains ORANGE for the same reasons as the baseline 1998 law.

Why this score

The 2009 amendment (Law No. 573 of 3 December 2009) is listed in the consolidated text and on WIPO Lex. WIPO Lex hosts the 'Law on Copyright and Related Rights (as amended up to 2009)' but the full text was not directly accessible in my search. The core exception structure (Arts. 20-22) appears to have been maintained. Classification remains ORANGE based on the personal-use exception with work-type exclusions.
